Please read these terms and conditions carefully before placing an order for a full body scan provided by Inlet Yoga Studio (referred to as "the Company").
By completing a purchase through our e-commerce platform, you (referred to as "the Customer") agree to be bound by the following terms and conditions:
Scheduling:
1.1. It is the Customer's sole responsibility to schedule their full body scan appointment using the Company's designated scheduling tools or by working with a designated Inlet Yoga representative. The Company will not be held liable for any failure on the Customer's part to schedule their appointment.
1.2. The Customer acknowledges and agrees that failure to schedule their appointment within a reasonable time may result in a delay or inability to perform the full body scan.
1.3. If a Customer allows their membership to lapse without scheduling their body scans, any unscheduled scans will be forfeited. The Customer will then be required to purchase new scans if they wish to avail the service in the future. The Company will not be responsible for any unscheduled scans lost due to membership lapses.
Limitation of Liability:
2.1. The Customer understands and agrees that the full body scans obtained from the FIT3D full body scanner are provided for informational purposes only and should not replace professional medical advice.
2.2. The Company does not guarantee the accuracy, completeness, or reliability of the full body scans or any information derived from them.
2.3. The Customer acknowledges that any reliance on the full body scan results is done at their own risk, and the Company shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use the full body scan results.
Refund Policy:
3.1. The Company operates under a strict no refund policy for full body scans. Once a full body scan has been completed for a single, or series of purchased scans, and the first scan is delivered to the Customer via the Fit3D portal, no refunds will be provided.
3.2. The Customer understands and agrees that after 90 days from the date of purchase, no refund requests will be accepted.
3.3. If a Customer allows their membership to lapse without scheduling their body scans, they are ineligible for any refund for the unused scans. The Customer acknowledges that it was their sole responsibility to schedule their body scans as stated in 1.1 of the terms and conditions. Any unscheduled scans due to membership lapses will not be considered for refunds under any circumstances.
Liability Waiver:
4.1. The Customer acknowledges that participation in the full body scan is voluntary and that any information obtained from the full body scan is not intended to replace medical advice.
4.2. The Customer agrees to release, indemnify, and hold harmless the Company, its directors, employees, and affiliates from any claims, damages, or liabilities arising from or related to the full body scan or its results.
Physical Damage & Liability to the Scanner Equipment:
5.1 Physical Damage: Liability for Physical Damage: In the event that you, as a user of the FIT3D scanner, cause any physical damage to the scanner or its components, including but not limited to the arm, rotating platform, buttons, cameras, laptop, pillar stand, or any other part of the scanner, you will be held liable for any and all costs associated with repairing the physical damage.
5.2 Repair Costs: You understand and acknowledge that repairing the FIT3D scanner and its components can be expensive. Therefore, you agree to fully compensate Inlet Yoga Studio for all costs incurred in repairing the physical damage caused by your actions, including the costs of replacement parts, labor, and any additional expenses necessary to restore the scanner to its original condition.
5.3 Reporting Damages: In the event that you accidentally or intentionally cause physical damage to the FIT3D scanner, it is your responsibility to immediately report the incident to Inlet Yoga Studio. Prompt reporting will help mitigate any potential further damage and ensure timely repairs, or litigation.
5.4 Inspection and Assessment: Inlet Yoga Studio reserves the right to conduct a thorough inspection and assessment of the damaged FIT3D scanner components to determine the extent of the physical damage and the associated repair costs. This inspection may include evaluating the cause of the damage and assessing any other factors that may have contributed to the incident.
5.5 Payment and Reimbursement: Upon receipt of the invoice for repair costs, you agree to promptly make payment to Inlet Yoga Studio for the full amount specified by cash or personal credit card. Failure to make payment within the specified timeframe may result in additional penalties or legal actions as deemed necessary by Inlet Yoga Studio. If paid by personal credit card, Inlet Yoga Studio reserves the right to add 3.5% fee and an additional processing fee no more than 20% of the payment processors processing fee.
5.6 Indemnification: You agree to indemnify and hold Inlet Yoga Studio harmless from any claims, losses, damages, liabilities, or expenses (including legal fees) that may arise from your use of the FIT3D scanner or the physical damage caused to the scanner or its components.
5.7 User Responsibility: As a user of the FIT3D scanner, you are responsible for using the scanner in a safe and careful manner, following any provided instructions, guidelines, or warnings. Any intentional misuse or reckless behavior that leads to physical damage will result in full liability for the repair costs.
5.8 Modification or Discontinuation: Inlet Yoga Studio reserves the right to modify or discontinue the use of the FIT3D scanner at any time without prior notice. In such cases, Inlet Yoga Studio shall not be held liable for any damages or losses resulting from the modification or discontinuation.
Privacy Policy:
6.1. The Customer acknowledges and agrees that any personal information provided during the purchase and scheduling process will be collected and used in accordance with the Company's privacy policy.
